Terms of Service

These Terms of Service ("Terms") govern your use of Cutly ("the Service"), operated by Cutly Ltd ("Cutly", "we", "us", "our"), a company registered in England and Wales.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Cutly is a subscription-based appointment booking and business management platform designed for barbershops and hair salons in the United Kingdom. The Service includes:
- Online booking pages for your clients
- Calendar and appointment management
- Client database and communication tools
- AI-powered business assistant (Cutly AI)
- Automated notifications (email, SMS, WhatsApp where enabled)
- Payment processing via Stripe
- Analytics and reporting
2. Accounts
2.1 You must be at least 18 years old to create an account.
2.2 You are responsible for keeping your login credentials secure. You are liable for all activity that occurs under your account.
2.3 You must provide accurate and complete information when registering. If your information changes, you must update it promptly.
2.4 We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
3. Subscription and Billing
3.1 Pricing. Cutly charges a flat monthly base fee plus a per-chair fee for each additional chair beyond the first. Current pricing is displayed at getcutly.app/pricing. Prices are shown exclusive of VAT. VAT at the prevailing UK rate will be added at checkout.
3.2 Billing cycle. Subscriptions are billed monthly in advance via Stripe. Your billing date is set on the date you first subscribe.
3.3 Chair count. You are responsible for keeping your chair count accurate in Settings. If you add chairs, the additional charge takes effect at the next billing cycle. If you remove chairs, the reduction takes effect at the next billing cycle — there are no partial-month credits.
3.4 Free trial. Where a free trial is offered, no payment is taken until the trial ends. You may cancel during the trial at no charge. If you do not cancel, your subscription begins automatically at the end of the trial period.
3.5 Failed payments. If a payment fails, we will retry on days 3, 5, and 7. If payment is not collected within 7 days, your account will be suspended. Access is restored immediately upon successful payment.
3.6 Price changes. We will give you at least 30 days' written notice (by email) of any price changes. Continued use of the Service after the notice period constitutes acceptance of the new price.
4. Cancellation and Refunds
4.1 You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of your current billing period. You retain full access until then.
4.2 We do not offer refunds for unused portions of a billing period, except where required by UK consumer law.
4.3 Upon cancellation, your data is retained for 30 days, after which it is permanently deleted. You may export your data at any time before cancellation.
5. Your Clients' Data
5.1 When your clients book appointments through Cutly, their personal data (name, phone number, email address, appointment history) is stored on your behalf. You are the data controller for your clients' data. Cutly acts as a data processor.
5.2 You must have a lawful basis to collect and process your clients' data. By using Cutly, you confirm that you have obtained any necessary consents from your clients.
5.3 You must not use Cutly to send unsolicited marketing communications to clients who have not consented to receive them.
5.4 Our full data processing obligations are set out in our Privacy Policy and, where applicable, a Data Processing Agreement available on request.
6. Acceptable Use
You must not use the Service to:
- Violate any UK law or regulation
- Harass, abuse, or harm any person
- Send spam or unsolicited bulk messages
- Attempt to gain unauthorised access to Cutly's systems or another user's account
- Reverse-engineer, copy, or resell any part of the Service
- Use the Service for any purpose other than managing your barbershop or salon business
7. Cutly AI
7.1 Cutly AI is powered by third-party AI models (including Anthropic Claude and Google Gemini). Outputs from Cutly AI are generated automatically and may not always be accurate.
7.2 You are responsible for reviewing AI-generated content (messages, captions, suggestions) before acting on it or sending it to clients.
7.3 Cutly AI may take automated actions on your behalf (such as sending messages to clients) when explicitly authorised by you within the product. You are responsible for reviewing these authorisations.
7.4 We are not liable for any loss or damage arising from reliance on AI-generated outputs.
8. Notifications (SMS, WhatsApp, Email)
8.1 Automated notifications sent by Cutly on your behalf (booking confirmations, reminders, review requests) are subject to the terms of our third-party providers (Twilio for SMS/WhatsApp, and our email provider).
8.2 You acknowledge that notification delivery is not guaranteed and may be affected by factors outside our control (network issues, spam filters, carrier restrictions).
8.3 You are responsible for ensuring your clients have consented to receive notifications from your business.
8.4 SMS and WhatsApp messaging costs are included in your subscription. We reserve the right to introduce fair-use limits if usage significantly exceeds normal business levels.
9. Intellectual Property
9.1 Cutly and all associated software, designs, trademarks, and content are the intellectual property of Cutly Ltd. You may not copy, modify, or distribute them without our written consent.
9.2 You retain ownership of all data you input into Cutly (client records, business information, content). You grant Cutly a limited licence to process this data solely to provide the Service.
10. Availability and Uptime
10.1 We aim to provide a reliable service but do not guarantee 100% uptime. Planned maintenance will be announced in advance where possible.
10.2 We are not liable for losses resulting from downtime, technical failures, or service interruptions.
11. Limitation of Liability
11.1 To the maximum extent permitted by UK law, Cutly's total liability to you for any claim arising from these Terms or use of the Service is limited to the total fees paid by you in the 3 months preceding the claim.
11.2 Cutly is not liable for any indirect, consequential, or loss of profit damages.
11.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
